GENERAL CONDITIONS


OPĆENITO Ovi Opći uvjeti putovanja sastavni su dio programa putovanja (u daljnjem tekstu: Program putovanja), potvrde o uplati putovanja i Ugovora o paket aranžmanu (u daljnjem tekstu: Ugovor) sklopljenog između putničke agencije Gavan turizam d.o.o. (u daljnjem tekstu Agencija) i korisnik, odnosno usluga osobe koja kreće na putovanje (u daljnjem tekstu: Putnik), odnosno ugovaratelj putovanja koji u svoje ime ili treća osoba kao Putnik sklapa Ugovor s Agencija (u daljnjem tekstu: izvođač). Svi pojmovi korišteni u ovim Uvjetima i odredbama imat će značenje koje im je dano u ovom odjeljku Uvjeta i odredbi. Sve potvrđene rezervacije podliježu ovim Općim uvjetima putovanja. Sve informacije i uvjeti iz ovih Općih uvjeta obvezuju Ugovaratelja/Putnika i Agenciju, osim ako privatnim ugovorom nije drugačije određeno.

IN GENERAL These General Travel Terms and Conditions are an integral part of the travel program (hereinafter: Travel Program), confirmation of payment for the trip and the package deal Agreement (hereinafter: Agreement) concluded between the travel agency Gavan turizam d.o.o. (hereinafter the Agency) and the user, i.e. the service of the person embarking on the trip (hereinafter: the Traveler), i.e. the travel contractor who, on his own behalf or a third person as the Traveler, enters into a Contract with the Agency (hereinafter: the contractor). All terms used in these Terms and Conditions shall have the meaning given to them in this section of the Terms and Conditions. All confirmed reservations are subject to these General Travel Conditions. All information and conditions from these General Terms and Conditions are binding on the Contractor/Traveler and the Agency, unless otherwise stipulated by a private contract.


ZAŠTITA OSOBNIH PODATAKA Osobne podatke putnik daje dobrovoljno. Osobni podaci putnika nužni su za realizaciju ugovorenog putovanja, odnosno turističkog paket aranžmana te će se koristiti za daljnju komunikaciju i ugovaranje usluga uključenih u turistički paket aranžman. Gavan turizam se obvezuje da će strogo čuvati osobne podatke putnika te ih neće koristiti osim u svrhu realizacije dogovorenih aranžmana. Putnik je suglasan da se njegovi osobni podaci mogu koristiti u svrhu marketinških kampanja Gavant turizma. Prije prijave za aranžman, odnosno slanja osobnih podataka i organiziranja putovanja za sebe ili nekog drugog, molimo Vas da se detaljno upoznate s odredbama Uredbe (EU) 2016/679 EUROPSKOG PARLAMENTA I VIJEĆA od 27. travnja 2016 privatnosti i zaštiti osobnih podataka

PROTECTION OF PERSONAL DATA The passenger provides personal data voluntarily. The passenger's personal data is necessary for the realization of the contracted trip, i.e. the tourist package arrangement and will be used for further communication and contracting of services included in the tourist package arrangement. Gavan turizam undertakes to strictly protect the personal data of passengers and will not use them except for the purpose of realizing the agreed arrangements. The traveler agrees that his personal data can be used for the purpose of Gavant turizam's marketing campaigns. Before applying for an arrangement, or sending personal data and arranging a trip for yourself or someone else, please familiarize yourself in detail with the provisions of the Regulation (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND COUNCIL of April 27, 2016 on privacy and personal data protection.


PRIJAVE I REZERVACIJE Prijave za aranžman mogu se izvršiti dostavom potrebnih podataka putem faksa, e-maila, mobitela ili putem interneta. Osoba koja je izvršila rezervaciju i/ili uplatu u ime Putnika (Ugovaratelj) potvrđuje da je ove Opće uvjete proslijedila svim osobama na toj rezervaciji, odnosno da ih je s njima upoznala. Ovi Opći uvjeti odnose se na sve osobe navedene u rezervaciji, a Izvršitelj potvrđuje da je ovlašten djelovati u ime svih Putnika navedenih u rezervaciji. Za potvrdu rezervacije Ugovaratelj/Putnik je dužan uplatiti akontaciju od minimalno 40% ukupne cijene aranžmana (osim ako nije drugačije navedeno u programu). Ostatak do ukupne cijene aranžmana uplaćuje se najkasnije 14 dana prije početka putovanja (ukoliko nije drugačije navedeno u programu) ili se dostavlja dokumentacija za nespornu uplatu ukupne cijene aranžmana. Ukoliko Ugovaratelj/Putnik ne uplati preostali iznos aranžmana u ugovorenom roku, smatrat će se da je odustao od rezervacije te će Agencija postupiti prema uvjetima otkaza putovanja od strane Putnika. Akontacija će biti uključena u cijenu izleta. Ukoliko Agencija ne može potvrditi rezervaciju za koju je uplaćena akontacija, uplaćeni iznos akontacije bit će vraćen uplatitelju u cijelosti. Osoba koja je izvršila rezervaciju u ime drugih Putnika uplatom akontacije ili cjelokupnog iznosa putovanja potvrđuje da je upoznata s činjenicom da se uplata odnosi na sve putnike na istoj rezervaciji, da su ti Putnici navedeni na Ugovora o putovanju, te da se uplaćeni iznos ravnomjerno raspoređuje na sve putnike na toj rezervaciji, osim ako Ugovorom i potvrdom o uplati nije drugačije određeno, odnosno pisanim putem prije same uplate ili neposredno nakon nje. Osoba koja je izvršila rezervaciju u ime ostalih putnika dužna je sve putnike na toj rezervaciji upoznati sa sadržajem Ugovora o putovanju, kao i ovim općim uvjetima. U slučaju da osoba koja je izvršila rezervaciju u ime drugih putnika želi sama organizirati svoje putovanje neovisno o ostalim putnicima, dužna je o tome obavijestiti Agenciju najkasnije u roku od 48 sati od primitka Ugovora o putovanju, u suprotnom, realizacija aranžmana a početak putovanja bit će moguć tek nakon što agencija primi cjelokupnu uplatu za sve Putnike navedene u Ugovoru o putovanju.
Ugovaratelj/Putnik dužan je pravodobno dati osobne podatke i dostaviti svu dokumentaciju potrebnu za organizaciju i provedbu putovanja. Agencija je imala pravo zatražiti i zadržati preslike dokumenata ukoliko je to potrebno za realizaciju putovanja. U slučaju da Ugovaratelj/Putnik ne dostavi tražene podatke u roku i na način koji odredi Agencija, smatra se da je odustao od Ugovora. Ugovaratelj/Putnik odgovara za svu štetu koja nastane njemu ili Agenciji zbog davanja netočnih i/ili nepotpunih podataka ili dokumenata. U slučaju uplaćenog i potvrđenog aranžmana, svaka promjena datuma ili imena putnika plaća se prema važećim cjenicima i pravilima društva. Prihvaćanjem ponude i uplatom (djelomično ili u cijelosti) Ugovaratelj/Putnik potvrđuje da je upoznat sa sadržajem aranžmana i programom putovanja, kao i ovim Općim uvjetima, te da ih prihvaća u njihovu cjelovitost. Rezervacija će biti izvršena i važeća tek kada Agencija istu potvrdi i ispostavi račun Ugovaratelju/Putniku ili ovlaštenom posredniku preko kojeg je Ugovaratelj/Putnik izvršio rezervaciju. Nijedan Ugovor nije valjan bez gotovinskog depozita, odnosno djelomične ili cjelovite uplate, bez koje se neće izdati potvrda o uplati niti račun za potvrdu rezervacije.
Na temelju zaprimljene prijave za putovanje, a nakon zaprimljene djelomične ili potpune uplate iznosa putovanja od strane Ugovaratelja/Putnika, Agencija će Ugovaratelju/Putniku uručiti Ugovor o putovanju koji se smatra sklopljenim i obvezujućim ukoliko Ugovaratelj/Putnik nije izvršio ugovor o putovanju. podnio pisani prigovor na ove Opće uvjete. u roku od 48 sati (isključivo pisanim putem elektroničkom poštom ili običnom preporučenom poštom). Za "fiksne rezervacije na upit" (individualni aranžmani gdje je moguća samo obvezujuća rezervacija uz uplatu cjelokupnog iznosa), Agencija neće prihvatiti fiksnu rezervaciju na upit bez uplate. Ukoliko Ugovaratelj/Putnik ne prihvati potvrđenu rezervaciju učinjenu prema njegovom zahtjevu, Agencija će zadržati uplaćeni iznos za pokriće troškova rezervacije. Ukoliko Agencija nije u mogućnosti izvršiti rezervaciju za

To confirm the reservation, the Contractor/Traveler is obliged to make an advance payment of at least 40% of the total price of the arrangement (unless otherwise specified in the program). The balance up to the total price of the arrangement is paid no later than 14 days before the start of the trip (unless otherwise stated in the program) or documentation is provided for undisputed payment of the total price of the arrangement. If the Contractor/Traveler does not pay the remaining amount of the arrangement within the stipulated period, it will be considered that he has given up the reservation and the Agency will act according to the terms of cancellation of the trip by the Traveler. The advance payment will be included in the price of the trip. If the Agency is unable to confirm the reservation for which the advance payment was made, the amount paid for the advance payment will be returned to the payer in full. A person who made a reservation on behalf of other Travelers by paying an advance payment or the entire amount of the trip confirms that they are aware of the fact that the payment refers to all passengers on the same reservation, that these Passengers are listed on the Travel Agreement, and that the amount paid is distributed equally among all passengers on that reservation, unless otherwise defined by the Agreement and confirmation of payment, i.e. in writing before the payment itself or immediately after it. The person who made the reservation on behalf of other passengers is obliged to inform all passengers on that reservation about the content of the Travel Agreement, as well as these general conditions. In the event that the Person who made the reservation on behalf of other passengers wishes to arrange their own trip independently of other passengers, they must notify the Agency within 48 hours of receiving the Travel Agreement at the latest, otherwise, the realization of the arrangement and the start of the trip will only be possible after the agency receives the entire payment for all Passengers listed on the Travel Agreement.
The Contractor/Traveler is obliged to provide personal data and submit all documentation necessary for the organization and implementation of the trip in a timely manner. The agency had the right to request and keep copies of documents if this is necessary for the realization of the trip. In the event that the Contractor/Traveler does not submit the requested information within the time limit and in the manner specified by the Agency, it is considered that he has abandoned the Contract. The Contractor/Traveller is responsible for all damage that occurs to him or the Agency due to the provision of incorrect and/or incomplete information or documents. In the case of a paid and confirmed arrangement, any change of date or name of the passenger is paid according to the applicable price lists and company rules. By accepting the offer and making the payment (partial or full amount), the Contractor/Traveler confirms that he is familiar with the content of the arrangement and the travel program, as well as these General Terms and Conditions, and that he accepts them in their entirety. The reservation will be completed and valid only when the Agency confirms it and sends the invoice to the Contractor/Traveler or the authorized intermediary through whom the Contractor/Traveler made the reservation. No Contract is valid without a cash deposit, i.e. partial or full payment, without which neither the payment confirmation nor the invoice confirming the reservation will be issued.
On the basis of the received travel application, and after receiving partial or full payment of the travel amount by the Contractor/Traveler, the Agency will hand the Contractor/Traveler a Travel Agreement which is considered concluded and binding if the Contractor/Traveler has not filed any written objection to these General Terms and Conditions. within 48 hours (exclusively in writing via electronic mail or regular registered mail). For "fixed inquiry reservations" (individual arrangements where only a binding reservation is possible by paying the entire amount), the Agency will not accept a fixed inquiry reservation without payment. If the Contractor/Traveler does not accept the confirmed reservation made according to his request, the Agency will keep the amount paid to cover the reservation costs. If the Agency is not able to provide a reservation for the requested arrangement on a "fixed request", the full amount of the payment will be returned to the Contractor/Traveler.


CIJENA I SADRŽAJ ARANŽMANA Cijene aranžmana objavljene su u eurima (€) i vrijede od trenutka objave na web stranicama agencije. Cijene aranžmana su promjenjive tijekom vremena i podložne su različitim akcijama s ciljem popunjavanja preostalih slobodnih mjesta. Cijene aranžmana nakon rezervacije, ugovaranja putovanja i uplate aranžmana su fiksne i ni na koji način nisu podložne promjenama, osim u slučaju značajnog smanjenja sadržaja samog aranžmana od strane Agencije. 
Ugovaratelj uplatom putovanja potvrđuje da je upoznat s činjenicom da se cijena za druge putnike može promijeniti uslijed naknadnih akcija i promocija koje utječu na cijenu, te da te cijene mogu biti niže, dok Agencija jamči putnika da se ugovorena cijena aranžmana neće povećavati nakon prve uplate bez obzira na naknadne promjene cijena koje mogu biti veće. Informativne cijene ulaznica za atrakcije i ostalih doplata na licu mjesta objavljene na stranicama Agencije samo su informativnog karaktera i ne moraju nužno odgovarati cijenama na licu mjesta u destinaciji u kojoj putnik boravi, a koje su promjenjive prirode, te svaka razlika u cijeni se ne može prigovoriti. Sadržaj aranžmana, odnosno cijena aranžmana uključuje ono što je Agencija navela u programu putovanja.

Cijena aranžmana, ako Ugovorom nije drukčije određeno, u pravilu uključuje usluge prijevoza, smještaja, troškove organizacije putovanja i obvezno pravno osiguranje (odgovornost i jamstvo). Ukoliko je posebno navedeno u segmentu "Cijena uključuje", cijena može uključivati uslugu i troškove stručnog lokalnog vodiča, dodatne obroke, izlete i sl. 


Cijena aranžmana u pravilu ne uključuje, osim ako nije drugačije dogovoreno: 

  • pristojbe zračnih luka, 
  • troškovi nabave i izdavanja vize,
  • ulaznice za objekte i znamenitosti koje se posjećuju,
  • boravišna pristojba, 
  • dodatni obroci koji nisu uključeni u cijenu, 
  • izleti koji nisu navedeni u segmentu "Cijena uključuje", a posebno su navedeni kao "izlet" u programu putovanja
  • te svi izborni sadržaji. 

Dodatne i posebne usluge (kao što su: transferi, dodatni obroci, posebni obroci, fakultativni izleti, stručno lokalno vodstvo, ulaznice, ishođenje viza, cijepljenja, putno osiguranje, napojnice, doplata za jednokrevetnu sobu i sl.) uključene su u cijenu aranžmana. samo ako je to izričito navedeno u programu u segmentu "Cijena uključuje", u suprotnom ih je Ugovaratelj / Putnik dužan platiti prilikom prijave za navedenu uslugu. 

Fakultativne i posebne usluge koje Putnik zatraži tijekom putovanja plaćaju se pratitelju putovanja ili predstavniku organizatora u valuti zemlje u kojoj se usluga pruža. Za usluge koje se plaćaju na licu mjesta, Putnik eventualni prigovor podnosi izravno davatelju usluge, a Agencija ne snosi nikakvu odgovornost za tu uslugu, bez obzira na pomoć pri njezinu dobivanju. 

Za doplate na licu mjesta, cijene objavljene u programu putovanja su informativne i podložne promjenama. Agencija zadržava pravo povećanja ugovorene cijene aranžmana u slučaju da nakon sklapanja Ugovora dođe do promjene tečaja valute ili povećanja cijena usluga koje čine aranžman, a posebno povećanje cijena prijevoza, uključujući gorivo, cestarine i sl., povećanje cijena smještaja i tarifa prijevoznika. O promjeni cijene Agencija može obavijestiti Ugovaratelja/Putnika pismeno ili usmeno. 

Ugovaratelj / Putnik se obvezuje prihvatiti povećanje ugovorene cijene do 10% (povećanje se obračunava na sve dijelove plaćanja). 
U slučaju da Ugovaratelj / Putnik raskine Ugovor zbog povećanja cijene manje od 10% ukupne cijene aranžmana, tada se primjenjuju uvjeti otkaza od strane Ugovaratelja / Putnika. 

Ukoliko dođe do povećanja ugovorene cijene za više od 10%, Ugovaratelj / Putnik ima pravo odustati od aranžmana, bez ikakve naknade, ako o tome pisanim putem obavijesti Agenciju u roku od 3 dana od primitka ugovora. obavijest. 
Ukoliko u navedenom roku Agenciji ne podnese ostavku u pisanom obliku, smatra se da je suglasan s promjenom cijene. 

U slučaju zrakoplovnih karata, zrakoplovne naknade podložne su promjenama do datuma izdavanja zrakoplovne karte. U slučaju povećanja zračnih pristojbi, Ugovaratelj / Putnik je dužan snositi troškove razlike u cijeni.

PRICE AND CONTENTS OF THE ARRANGEMENT The prices of the arrangements are published in euros (€) and are valid from the moment of publication on the agency's website. The prices of the arrangements are variable over time and are subject to various actions aimed at filling the remaining vacancies. The prices of the arrangement after booking, contracting the trip and paying for the arrangement are fixed and are not subject to change in any way, except in the case of a significant reduction in the content of the arrangement itself by the Agency.
By paying for the trip, the contractor confirms that he is aware of the fact that the price for other passengers may change due to subsequent actions and promotions that affect the price, and that these prices may be lower, while the Agency guarantees the passenger that the contracted price of the arrangement will not increase after the first payment without regardless of subsequent price changes that may be higher. Informative prices of tickets for attractions and other on-site surcharges published on the Agency's website are for information purposes only and do not necessarily correspond to on-site prices in the destination where the traveler is staying, which are of a variable nature, and any price difference cannot be objected to. . The content of the arrangement, that is, the price of the arrangement includes what the Agency stated in the travel program.

The price of the arrangement, unless otherwise specified in the Agreement, usually includes transportation services, accommodation, travel organization costs and mandatory legal insurance (liability and guarantee). If it is specifically stated in the "Price includes" segment, the price may include the service and costs of an expert local guide, additional meals, excursions, etc.


As a rule, the price of the arrangement does not include, unless otherwise agreed:

  • airport taxes,
  • the costs of obtaining and issuing a visa,
  • tickets for objects and sights that are visited,
  • accommodation tax,
  • additional meals that are not included in the price,
  • excursions that are not listed in the "Price includes" segment and are specifically listed as "excursion" in the travel program,
  • and all optional contents.

Additional and special services (such as: transfers, additional meals, special meals, optional excursions, expert local guidance, tickets, visas, vaccinations, travel insurance, tips, supplement for a single room, etc.) are included in the package price. only if this is explicitly stated in the program in the "Price includes" segment, otherwise the Contractor / Traveler is obliged to pay them when registering for the specified service.

Optional and special services requested by the Traveler during the trip are paid to the travel companion or representative of the organizer in the currency of the country where the service is provided. For services that are paid for on the spot, the Traveler submits any complaint directly to the service provider, and the Agency bears no responsibility for that service, regardless of the assistance in obtaining it.

For on-site surcharges, the prices published in the travel program are informative and subject to change. The Agency reserves the right to increase the agreed price of the arrangement in the event that after the conclusion of the Agreement there is a change in the currency exchange rate or an increase in the prices of the services that make up the arrangement, and in particular an increase in transportation prices, including fuel, tolls, etc., an increase in accommodation prices and carrier tariffs. The Agency can inform the Contractor/Traveler in writing or orally about the price change.

The contracting party / traveler undertakes to accept an increase in the agreed price of up to 10% (the increase is calculated on all parts of the payment).
In the event that the Contractor / Traveler terminates the Agreement due to a price increase of less than 10% of the total price of the arrangement, then the terms of cancellation by the Contractor / Traveler apply.

If there is an increase in the agreed price by more than 10%, the Contractor / Traveler has the right to withdraw from the arrangement, without any compensation, if he informs the Agency about this in writing within 3 days of receiving the contract. notice.
If he does not submit his resignation to the Agency in writing within the specified period, he is considered to have agreed to the price change.

In the case of air tickets, air charges are subject to change until the date of issue of the air ticket. In the event of an increase in air charges, the Contractor / Passenger is obliged to bear the cost of the price difference.


SMJEŠTAJ U SOBAMA/APARTMANIMA/KABINAMA Ukoliko Ugovaratelj / Putnik nije izričito ugovorio sobu, apartman ili kabinu s posebnim karakteristikama, prihvatit će u najam svaku službeno registriranu smještajnu jedinicu u objektu opisanom u programu putovanja. Ukoliko nije drugačije dogovoreno, smještaj je osiguran u dvokrevetnim sobama sa odvojenim ili francuskim ležajem. 

Putnik je dužan pridržavati se pravila smještajnih jedinica u pogledu vremena početka korištenja soba, apartmana, kabina i sl., te vremena napuštanja istih, u suprotnom putnik snosi sve dodatne troškove. 

Putnik samostalno odgovara za svu štetu nastalu tijekom boravka u smještajnoj jedinici (hotelu, vili, sobi, apartmanu, kabini, bungalovu, šatoru i sl.)  kao i za sve dodatne troškove nastale tijekom boravka koji nisu posebno navedeni u programu putovanja kao uključeni u cijenu (kao što su troškovi mini bara , dodatne usluge u hotelu uz nadoplatu i sl.). 

Smještaj u hotel i ulazak u smještajnu jedinicu u pravilu je moguć između 14 i 20 sati, a napustiti je u pravilu najkasnije do 10 sati na dan završetka usluge, osim ako nije drugačije navedeno u programu pojedinog smještajnog kapaciteta. 
Dolasci nakon 20 sati moraju se unaprijed najaviti, osim ako nije drugačije naznačeno. 
Ukoliko je moguće, Agencija će nastojati udovoljiti prethodno najavljenom zahtjevu za dodatnim smještajem Ugovaratelja / Putnika (opremljenost sobe, tip sobe s bračnim ili odvojenim ležajem, orijentacija sobe, kat, kućni ljubimci, pomoćni ležajevi, dječji krevetić i sl.), ali ne može jamčiti ispunjenje takvog zahtjeva ili visinu nadoplate ukoliko je ista određena od strane smještajnog objekta. 

Ukoliko Putnik ugovori trokrevetnu ili višekrevetnu sobu u hotelu, izričito naglašavamo da hotel može ustupiti dvokrevetnu sobu s pomoćnim ležajem namijenjenu za smještaj treće osobe bez prethodne obavijesti Agencije o istoj, a kvaliteta i oblik pomoćnog ležaja u potpunosti ovisi o hotelu, a može biti znatno lošije kvalitete od ostalih ležajeva. Agencija ni u kojem slučaju ne snosi odgovornost za bilo kakve probleme vezane uz kvalitetu pomoćnog ležaja, te eventualno nezadovoljstvo putnika proizašlo iz navedenih razloga ne može biti predmet prigovora. 

Sklapanjem Ugovora Ugovaratelj / Putnik potvrđuje da je suglasan i da u cijelosti prihvaća objavljenu ponudu i program sa svim njegovim elementima, te se odriče bilo kakvih daljnjih prigovora i reklamacija s tim u vezi.

ACCOMMODATION IN ROOMS/APARTMENTS/CABINS If the Contractor / Traveler has not expressly contracted a room, apartment or cabin with special characteristics, he will accept for rent any officially registered accommodation unit in the facility described in the travel program. Unless otherwise agreed, accommodation is provided in double rooms with separate or double beds.

The traveler is obliged to comply with the rules of the accommodation units regarding the time of starting to use rooms, apartments, cabins, etc., and the time of leaving them, otherwise the traveler bears all additional costs.

The traveler is independently responsible for all damages incurred during the stay in the accommodation unit (hotel, villa, room, apartment, cabin, bungalow, tent, etc.) as well as for all additional costs incurred during the stay that are not specifically stated in the travel program as included in the price. (such as the costs of the minibar, additional services in the hotel for a surcharge, etc.).

Accommodation in the hotel and entry into the accommodation unit is usually possible between 14:00 and 20:00, and it is usually possible to leave it no later than 10:00 on the day of the end of the service, unless otherwise stated in the program of the individual accommodation capacity.
Arrivals after 8 pm must be announced in advance, unless otherwise indicated.
If possible, the Agency will try to comply with the previously announced request for additional accommodation of the Contractor / Traveler (room equipment, type of room with a double or separate bed, orientation of the room, floor, pets, extra beds, cot, etc.), but cannot guarantee the fulfillment of such a request or the amount of the surcharge if it is determined by the accommodation facility.

KATEGORIZACIJA SMJEŠTAJA, KVALITETA SMJEŠTAJA, LOKACIJA I DRUGO Ponuđeni smještajni kapaciteti u okviru programa definirani su prema službenoj kategorizaciji dotične zemlje koja je važeća u trenutku izdavanja programa. Lokalna kategorizacija hotela značajno se razlikuje među državama, a prihvaćanjem ovih Općih uvjeta putnik izjavljuje da je s tom činjenicom upoznat. 

Hrana, udobnost i ostale usluge koje nude hoteli/apartmani pod nadzorom su lokalnih turističkih vlasti, a standardi smještaja i usluga izrazito su različiti i neusporedivi, a kvaliteta može jako varirati. 

Lokacija hotela, koja može biti navedena na web stranicama Agencije, može se definirati u kilometrima od centra grada (pri čemu je centar grada definiran kao područje od najviše 2 km od glavnog gradskog trga) ili minutama vrijeme putovanja do centra grada (pri čemu se podrazumijeva okvirna udaljenost +/- 10 min. u definiranim minutama vožnje raspoloživim oblikom javnog prijevoza definiranim aplikacijom "Google Maps", koja ne uključuje vrijeme od / do stanice , kao i vrijeme čekanja). 

Agencija će u završnoj obavijesti (koja se šalje e-poštom najkasnije dva kalendarska dana prije polaska) obavijestiti putnike o točnom hotelu u kojem će biti smješteni. Molimo putnike da se prije polaska informiraju o lokaciji i kvaliteti smještaja putem navedenih podataka kao što su naziv hotela i internetske poveznice, a sve pritužbe na smještaj podnose agenciji u pisanom obliku, najkasnije 24 sata. prije polaska. Usluga doručka, ukoliko je ugovorena, može uvelike varirati ovisno o destinaciji, običajima i samoj razini kvalitete i usluge pojedinog hotela, a Agencija ni u kojem slučaju ne preuzima odgovornost za kvalitetu ili sadržaj doručka, te Putnik ugovaranjem putovanja posebno izjavljuje da je s tom činjenicom upoznat. 

Agencija zadržava pravo promjene hotela pod uvjetom da ponudi hotel iste ili više kategorije. Agencija ne jamči određena mjesta u autobusu, a uplatom paket aranžmana smatra se da je putnik prihvatio bilo koje mjesto u autobusu, uključujući i mjesta u prvom i zadnjem redu autobusa.

CATEGORIZATION OF ACCOMMODATION, QUALITY OF ACCOMMODATION, LOCATION AND OTHER The offered accommodation capacities within the program are defined according to the official categorization of the country in question, which is valid at the time the program is issued. The local categorization of hotels differs significantly between countries, and by accepting these General Conditions, the traveler declares that he is aware of this fact.

Food, comfort and other services offered by hotels/apartments are under the supervision of local tourism authorities, and the standards of accommodation and services are extremely different and incomparable, and the quality can vary greatly.

The location of the hotel, which can be listed on the Agency's website, can be defined in kilometers from the city center (where the city center is defined as an area of no more than 2 km from the main city square) or the travel time to the city center in minutes (whereby approximate distance +/- 10 minutes in defined driving minutes by the available form of public transport defined by the "Google Maps" application, which does not include time from / to the station, as well as waiting time).

In the final notification (which is sent by e-mail no later than two calendar days before departure), the agency will inform the passengers about the exact hotel where they will be accommodated. We ask travelers to inform themselves about the location and quality of the accommodation before departure using the above information, such as the name of the hotel and internet links, and submit all complaints about the accommodation to the agency in writing, no later than 24 hours. before departure. Subsequent objections, after the traveler has used the contracted accommodation service, will not be accepted, and the traveler, by contracting the trip, expressly declares that he is aware of this fact and that he waives the right to object if the accommodation is in a hotel as defined in the final notification.

The breakfast service, if contracted, can vary greatly depending on the destination, customs and the very level of quality and service of an individual hotel, and the Agency in no case assumes responsibility for the quality or content of the breakfast, and the Traveler, by contracting the trip, specifically declares that he is aware of this fact familiar.

The agency reserves the right to change the hotel on the condition that it offers a hotel of the same or higher category. The agency does not guarantee specific seats on the bus, and by paying for the package deal, the passenger is considered to have accepted any seat on the bus, including seats in the first and last row of the bus.


OBVEZE AGENCIJE  Agencija se obvezuje brinuti o realizaciji programa putovanja. Agencija se obvezuje Putniku pružiti sve usluge navedene u segmentu "CIJENA UKLJUČUJE" u okviru programa putovanja, te izdati odgovarajuću dokumentaciju (potvrdu o uplati/Ugovor) za uplaćeno putovanje. Agencija isključuje svaku odgovornost u slučaju promjena i neizvršenja usluga uzrokovanih višom silom (rat, pobune, štrajkovi, terorističke akcije, sanitarni poremećaji, vremenske nepogode, intervencije nadležnih tijela, prometne nesreće, zastoji, kašnjenja i smetnje u prometu). javnog prijevoza u gradu koji se posjećuje i sl.), te zbog kašnjenja prijevoznih sredstava za koje prijevoznik ne odgovara prema pozitivnim propisima i međunarodnim konvencijama. U tim slučajevima Agencija nije dužna snositi dodatne troškove Putniku. Agencija nije dužna pružati usluge izvan ovih Uvjeta.

OBLIGATIONS OF THE AGENCY The agency is obliged to take care of the implementation of the travel program. The Agency is obliged to provide the Traveler with all the services listed in the "PRICE INCLUDES" segment within the travel program, and to issue appropriate documentation (payment confirmation / Contract) for the paid trip. The agency excludes any responsibility in case of changes and non-performance of services caused by force majeure (war, riots, strikes, terrorist actions, sanitary disturbances, weather disasters, intervention of competent authorities, traffic accidents, traffic jams, delays and disruptions of public transport in the city being visited, etc. .), and due to the delay of means of transport for which the carrier is not responsible according to positive regulations and international conventions. In these cases, the Agency is not obliged to cover the additional costs of the Passenger. The Agency is not obliged to provide services outside of these Terms.


OBVEZE PUTNIKA Putnik je dužan doći na vrijeme polaska, a najkasnije 15 minuta prije planiranog polaska. Ukoliko Putnik ne stigne u predviđeno vrijeme polaska, Agencija ima pravo započeti putovanje bez Putnika. 

Putnik je dužan pridržavati se kućnog reda i pravila ponašanja u smještajnim objektima (npr. hoteli, hosteli, apartmani, rezidencije, privatni smještaj i dr.) ili prijevoznim sredstvima te ne ugrožavati redovito i nenametljivo odvijanje programa putovanja. svojim djelovanjem. Ako Putnik na bilo koji način narušava sigurnost, remeti vozačevu vožnju, mir, udobnost ili udobnost drugih putnika ili ugrožava i/ili otežava redovito odvijanje programa putovanja, Agencija, osim prava na punu naknadu za materijalne i nematerijalne štete, ima pravo za tog Putnika prekinuti putovanje, bez iste nastaviti realizaciju programa putovanja, u kojem slučaju će se smatrati da je putovanje prekinuto na zahtjev Putnika, a Putnik sam će biti odgovoran za naknadu svih troškova proizašlih iz istog. Ukoliko je u tom slučaju Putnik maloljetna osoba ili dijete, roditelj je dužan osigurati povratak djeteta kući ili o svom trošku doći po dijete. 

Putnik odgovara za štetu koju pretrpi Agencija, prijevoznik ili davatelj usluga uključenih u paket aranžman, a koja bi nastala zbog nepostupanja Putnika prema svojim obvezama. Putnik je dužan posjedovati važeće putne isprave, poštivati carinske i devizne propise zemlje u koju ide i zemlje kroz koju prolazi. U slučaju nemogućnosti nastavka putovanja zbog kršenja propisa od strane Putnika, Agencija ima pravo nastaviti putovanje bez Putnika, a sve nastale troškove snosi sam Putnik. Putnik je dužan snositi troškove aranžmana prema ovim uvjetima. 

Putnik je dužan pridržavati se svih uputa i u dobroj vjeri surađivati s predstavnikom agencije. U slučaju bilo kakvog nezadovoljstva, putnik je dužan mirno i u dobroj vjeri surađivati s predstavnikom Agencije i na licu mjesta pokušati riješiti nezadovoljstvo, bez javnog izražavanja nezadovoljstva i bez utjecaja na druge putnike. Agencija, odnosno predstavnik agencije, učinit će sve što je u razumnoj moći da otkloni nezadovoljstvo putnika bez negativnog utjecaja na druge putnike, predviđenu satnicu ili program putovanja. 

U slučaju da Putnik tijekom putovanja, a prema prijavi predstavnika agencije, javno izrazi svoje nezadovoljstvo koje bi moglo utjecati na ostale putnike i/ili svojim ponašanjem na licu mjesta na bilo koji način narušiti ugled agencije, Agencija ima pravo na ime štete nanesene ugledu Agencije zahtijevati naknadu štete do visine od 20 % od ukupnog iznosa koji su platili svi putnici iz te grupe, a Putnik ugovaranjem putovanja izričito izjavljuje da je s tom činjenicom upoznat, te se posebno obvezuje da tijekom putovanja ni na koji način neće narušiti ugled agencije. 

Ugovaranjem putovanja putnik se posebno obvezuje čuvati privatnost svih ostalih putnika u grupi, te da njihove osobne podatke neće zapisivati, snimati, fotografirati ili na bilo koji način pohranjivati, kao što je bilo kakav dokument ili papir s popisom imena i prezimena te sve ostale osobne podatke definirane GDPR uredbom. 

Putnik izričito izjavljuje da je upoznat s činjenicom da je prema GDPR uredbi, odnosno Općoj uredbi o zaštiti podataka (Uredba (EU) 2016/679 Europskog parlamenta i Vijeća od 27. travnja 2016.) bilo kakvo snimanje tuđih osobnih podataka za koje Gavan turizam d.o.o. putnička agencija definirana kao voditelj obrade podataka prema GDPR uredbi, može biti kažnjena novčanom kaznom i do više stotina tisuća eura, te da Gavan Turizam ima pravo tražiti naknadu za svu štetu nastalu protupravnim kršenjem privatnosti drugim članovima grupe od strane bilo kojeg Putnika. 

Putnik se obvezuje postupati u dobroj vjeri prije, za vrijeme ili nakon putovanja. Putnik izjavljuje da je upoznat s činjenicom da Agencija postupa u dobroj vjeri u cilju postizanja što većeg zadovoljstva svih putnika transparentnim priopćavanjem što većeg broja činjenica prije putovanja. Slijedom navedenog, Putnik se obvezuje upoznati se sa svim odredbama ovih Općih uvjeta koji su sastavni dio njegovog Ugovora o putovanju, te sa svim informacijama koje mu je Agencija pružila prije polaska kroz Program putovanja i Završnu obavijest. u slučaju nepoštivanja bilo koje od ovih odredbi.

OBLIGATIONS OF PASSENGERS The passenger is obliged to arrive at the time of departure, and no later than 15 minutes before the scheduled departure. If the Passenger does not arrive at the scheduled departure time, the Agency has the right to start the journey without the Passenger.

The traveler is obliged to comply with the house rules and rules of behavior in accommodation facilities (eg hotels, hostels, apartments, residences, private accommodation, etc.) or means of transport and not to endanger the regular and unobtrusive development of the travel program. by its action. If the Passenger violates safety in any way, disrupts the driver's driving, the peace, comfort or convenience of other passengers or endangers and/or hinders the regular development of the travel program, the Agency, in addition to the right to full compensation for material and non-material damages, has the right for that Passenger to terminate trip, without continuing the implementation of the travel program, in which case it will be considered that the trip was interrupted at the request of the Traveler, and the Traveler himself will be responsible for the compensation of all costs arising from it. If in that case the Passenger is a minor or a child, the parent is obliged to ensure the return of the child home or to pick up the child at his own expense.

The Passenger is responsible for damage suffered by the Agency, carrier or service provider included in the package deal, which would be caused by the Passenger's failure to comply with their obligations. The traveler is obliged to have valid travel documents, to respect the customs and foreign exchange regulations of the country he is going to and the country he is passing through. In case of impossibility to continue the trip due to violation of regulations by the Traveler, the Agency has the right to continue the trip without the Traveler, and all incurred costs are borne by the Traveler himself. The passenger is obliged to bear the costs of the arrangement according to these conditions.

The traveler is obliged to comply with all instructions and to cooperate with the agency representative in good faith. In case of any dissatisfaction, the passenger is obliged to cooperate calmly and in good faith with the representative of the Agency and try to resolve the dissatisfaction on the spot, without public expression of dissatisfaction and without influencing other passengers. The agency, or the representative of the agency, will do everything in its reasonable power to eliminate the passenger's dissatisfaction without negatively affecting other passengers, the scheduled hourly rate or the travel program.

In the event that the Passenger during the trip, and according to the report of the agency representative, publicly expresses his dissatisfaction, which could affect other passengers and/or damage the agency's reputation in any way by his behavior on the spot, the Agency has the right to demand compensation for damages up to 20% of the total amount paid by all travelers from that group, and the Traveler, by contracting the trip, expressly declares that he is aware of this fact, and specifically undertakes not to damage the reputation of the agency in any way during the trip.

By contracting the trip, the traveler undertakes to protect the privacy of all other passengers in the group, and that their personal data will not be written down, recorded, photographed or stored in any way, such as any document or paper with a list of names and surnames and all other personal data defined by the GDPR regulation.

The traveler expressly declares that he is aware of the fact that according to the GDPR regulation, i.e. the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016), any recording of other people's personal data for which Gavan turizam d.o.o. a travel agency defined as a data controller according to the GDPR regulation, can be fined up to hundreds of thousands of euros, and that Gavan Turizam has the right to claim compensation for all damages caused by illegal privacy violations of other group members by any Traveler.

The traveler undertakes to act in good faith before, during or after the trip. The passenger declares that he is aware of the fact that the Agency acts in good faith in order to achieve the greatest possible satisfaction of all passengers by transparently communicating as many facts as possible before the trip. Following the above, the Traveler undertakes to familiarize himself with all the provisions of these General Terms and Conditions, which are an integral part of his Travel Contract, and with all the information provided by the Agency before departure through the Travel Program and the Final Notice. in case of non-compliance with any of these provisions.


PRIGOVORI U slučaju da Putnik ima prigovor vezan uz neispunjenje pojedine usluge iz programa putovanja, Putnik je dužan svaki eventualni prigovor prijaviti pratitelju kako bi isti pokušali riješiti na licu mjesta. Naknadne reklamacije se neće uvažavati. Ističemo da je u interesu Putnika da postupa u dobroj vjeri i izrazi svoju volju za rješavanje reklamacija tijekom putovanja. Putnik je dužan surađivati s pratiteljem i davateljem usluge u dobroj namjeri kako bi se otklonili uzroci prigovora. 

Ukoliko Putnik na licu mjesta ne prihvati ponuđeno rješenje koje odgovara ugovorenoj usluzi, Agencija neće prihvatiti naknadni prigovor Putnika, niti je dužan na isti odgovoriti. 

Ukoliko i nakon reklamacije na licu mjesta usluga nije pružena na dogovoreni način, Putnik može podnijeti pisani prigovor agenciji po povratku s putovanja na sljedeći način: 
na licu mjesta (prije povratka s putovanja) zahtjev pismenu potvrdu osobe odgovorne za izvršenje usluge kojom putnik nije zadovoljan i istu priložiti uz svoj pismeni prigovor, e-mailom na Ova e-mail adresa je zaštićena od spambota. Potrebno je omogućiti JavaScript da je vidite.  ili preporučenom poštom na adresu Gavan turizam, doo, Krajiška 42, 10000. Zagreb, najkasnije 8 dana po povratku s putovanja.
 U protivnom, Agencija nije dužna predmetni prigovor uzeti u obzir. Reklamacija po povratku s putovanja bez priložene potvrde smatrat će se neutemeljenom. Potvrdu za sve usluge za koje je nadležna Agencija može dobiti od pratitelja na licu mjesta, a za sve ostale usluge, za koje Agencija nije nadležna, putnik istu mora ishoditi od pružatelja usluga koji nije u mogućnosti izvršiti uslugu na propisani način kako je Agencija pismeno priopćila. 

Svaki prigovor kupca podnosi se zasebno. Agencija neće razmatrati grupne prigovore. Agencija je dužna pismeno odgovoriti na prigovor u roku od 14 dana od dana primitka prigovora. Ukoliko je potrebno prikupiti obavijesti i provjeriti navode iz prigovora, Agencija može odgoditi rok za donošenje odluke za još 14 dana, te je dužna pisanim putem obavijestiti putnika o prigovoru. Agencija će rješavati samo one prigovore za koje Putnik pruži dokaz da je uputio pisani prigovor pružatelju usluge na licu mjesta i da uzrok nije mogao otkloniti na licu mjesta. 

Ukoliko krivnjom Agencije program ili dio usluga nije ispunjen, Putnik ima pravo na naknadu štete u visini stvarne vrijednosti neiskorištenih usluga i ne može uključiti već iskorištene usluge, kao ni cjelokupni iznos aranžmana. 
Dok traje postupak rješavanja, a ukupno najviše 30 dana od podnošenja prigovora, Putnik se neopozivo odriče posredovanja bilo koje druge osobe, arbitraže UHPA-e ili druge institucije, kao i davanja informacija medijima. 
Isto tako, za to vrijeme Putnik se odriče prava na tužbu. Maksimalan iznos naknade po reklamaciji može doseći iznos oglašenog dijela usluga, a ne može uključivati već iskorištene usluge niti cjelokupni iznos aranžmana. 
U svim aranžmanima u kojima Agencija posreduje u prodaji, za realizaciju je odgovoran organizator putovanja. U slučaju sklapanja ugovora po "fortuna sustavu" ili "unseen sustavu", Putnik nema pravo prigovora na smještaj. 

Putnik i Agencija će sporove nastojati riješiti mirnim putem, a u protivnom suglasni su da je nadležan sud u Zagrebu, a mjerodavno je pravo Republike Hrvatske. 

Prije podnošenja prigovora, Putnik je dužan provjeriti ispunjava li Agencija svoje ugovorne obveze iz ugovora o putovanju. Primjerice, ako putnik ima prigovor na smještaj, prigovor je osnovan u slučaju da Agencija nije za njega organizirala smještaj kako je rekla ili mu je organizirala smještaj niže službene kategorije u odnosu na priopćenje u Ugovoru o putovanju ili na mjesto koje se jako razlikuje od pisane komunikacije prije polaska. Inače, Putnik je dužan voditi računa o razlikama u kvaliteti između pojedinih hotela, kao i razlikama u službenoj kategorizaciji hotela između zemalja. Kvaliteta smještaja ne može biti osnova za reklamaciju ako je Agencija u dobroj namjeri, a prije polaska u Završnoj obavijesti dala podatke o kojem se točno hotelu radi, kako bi se putnik samostalno informirao o kvaliteti hotela putem recenzije prošlih putnika, kao i točnu lokaciju, prije polaska u hotel.

Javno izražavanje nezadovoljstva:
Putnik izjavljuje da je upoznat s činjenicom da će Agencija nastojati riješiti sve razloge eventualnog nezadovoljstva kako bi se postigla što veća razina zadovoljstva svih putnika. Prihvaćanjem ovih Općih uvjeta putnik izričito izjavljuje da će u dobroj namjeri nastojati sve razloge nezadovoljstva riješiti komunikacijom s Agencijom prije svake javne objave putem oblika javnog priopćavanja kao što je internet. 

Putnik izričito izjavljuje da će se suzdržati od javnih izjava ili objavljivanja neistinitih činjenica na internetu s ciljem narušavanja ugleda agencije, te da je svjestan da u protivnom čini kazneno djelo klevete, da Agencija ga je obavijestila o relevantnim dijelovima Kaznenog zakona (odlomak u nastavku) te da Agencija ima puno pravo pokrenuti parnični postupak radi naknade štete. Kaznenim djelom klevete čini se tko pred drugim o nekome iznese ili prenese neistinitu činjeničnu izjavu koja može povrijediti njegovu čast ili ugled (čl. 149. st. 1. KAZNENOG ZAKONA). Kleveta ne mora stvarno štetiti nečijoj časti i ugledu, ali može biti njezina posljedica (kazneno djelo apstraktnog ugrožavanja). Ono što je također važno za ovo kazneno djelo je da treća osoba mora saznati za klevetnički iskaz, a to proizlazi iz zakonske formulacije "tko prije drugoga". Kazna za takvo kazneno djelo je novčana kazna od tri stotine šezdeset dnevnih iznosa. Kvalificirani oblik kaznenog djela je onaj tko počini klevetu na javnom skupu ili na drugi način zbog kojeg je postala dostupna većem broju osoba (kao što je objava na internetu), a kazna za kvalificirani oblik je je novčana kazna od pet stotina dnevnih iznosa ((čl. 149. st. 2. KAZNENOG ZAKONA).

OBJECTIONS In the event that the Traveler has a complaint related to the non-fulfillment of a particular service from the travel program, the Traveler is obliged to report any possible complaint to the attendant so that they can try to resolve it on the spot. Subsequent complaints will not be accepted. We emphasize that it is in the Traveler's interest to act in good faith and express his will to resolve complaints during the trip. The passenger is obliged to cooperate with the companion and the service provider in good faith in order to eliminate the causes of the complaint.

If the Traveler does not accept the offered solution on the spot that corresponds to the contracted service, the Agency will not accept the Traveler's subsequent complaint, nor is it obliged to respond to it.

If, even after complaining on the spot, the service is not provided in the agreed manner, the Traveler can submit a written complaint to the agency upon returning from the trip as follows:

Each customer complaint is submitted separately. The Agency will not consider group complaints. The agency is obliged to respond in writing to the complaint within 14 days from the day of receipt of the complaint. If it is necessary to collect information and check the allegations from the complaint, the Agency can postpone the deadline for making a decision for another 14 days, and is obliged to inform the passenger about the complaint in writing. The Agency will handle only those complaints for which the Traveler provides proof that he sent a written complaint to the service provider on the spot and that he could not eliminate the cause on the spot.

If the program or part of the services is not fulfilled due to the Agency's fault, the Traveler has the right to compensation for damages in the amount of the actual value of the unused services and cannot include already used services, as well as the entire amount of the arrangement.
While the resolution process is ongoing, and in total no more than 30 days from the submission of the complaint, the Traveler irrevocably renounces mediation by any other person, arbitration by the UHPA or another institution, as well as providing information to the media.
Likewise, during this time the Passenger waives the right to sue. The maximum amount of compensation per complaint can reach the amount of the advertised part of the services, and cannot include already used services or the entire amount of the arrangement.
In all arrangements in which the Agency mediates sales, the travel organizer is responsible for implementation. In the case of concluding a contract according to the "fortuna system" or the "unseen system", the Traveler has no right to object to the accommodation.

The traveler and the Agency will try to resolve disputes amicably, otherwise they agree that the competent court is in Zagreb, and the applicable law is the law of the Republic of Croatia.

Before submitting a complaint, the Traveler is obliged to check whether the Agency fulfills its contractual obligations from the travel contract. For example, if the traveler has an objection to the accommodation, the objection is founded in the event that the Agency did not organize accommodation for him as it said or organized him accommodation of a lower official category compared to the communication in the Travel Agreement or to a place that is very different from the written communication before departure. Otherwise, the Traveler is obliged to take into account the differences in quality between individual hotels, as well as differences in the official categorization of hotels between countries. The quality of the accommodation cannot be the basis for a complaint if the Agency, in good faith, and before departure in the Final Notification provided information about the exact hotel in question, so that the traveler can independently inform himself about the quality of the hotel through the reviews of past travelers, as well as the exact location, before departure to the hotel.

Public expression of dissatisfaction:
The passenger declares that he is aware of the fact that the Agency will try to resolve all possible reasons for dissatisfaction in order to achieve the highest possible level of satisfaction for all passengers. By accepting these General Conditions, the traveler expressly declares that he will try in good faith to resolve all reasons for dissatisfaction by communicating with the Agency before any public announcement via a form of public communication such as the Internet.

The traveler expressly declares that he will refrain from making public statements or publishing untrue facts on the Internet with the aim of damaging the agency's reputation, and that he is aware that otherwise he commits the criminal offense of defamation, that the Agency has informed him about the relevant parts of the Criminal Code (paragraph below) and that the Agency has every right to initiate a civil procedure for compensation. It is a criminal act of defamation if anyone makes or transmits an untrue factual statement about someone in front of another person that may harm their honor or reputation (Art. 149, Paragraph 1, CRIMINAL LAW). Defamation does not have to actually harm someone's honor and reputation, but it can be its consequence (criminal offense of abstract endangerment). What is also important for this crime is that a third person must find out about the defamatory statement, and this follows from the legal wording "one before the other". The penalty for such a criminal offense is a fine of three hundred and sixty daily amounts. A qualified form of criminal offense is the one who commits defamation at a public meeting or in another way due to which it became available to a large number of people (such as publication on the Internet), and the penalty for the qualified form is a fine of five hundred daily amounts (Art. 149, paragraph 2 of the CRIMINAL ACT).


OTKAZ PUTOVANJA OD STRANE UGOVARATELJA / PUTNIKA Otkaz rezervacije/putovanja potrebno je poslati ili dostaviti Agenciji u pisanom obliku.
Datum pisanog otkaza temelj je za obračun naknade, odnosno troškova otkaza (otkazne kazne) koje će Agencija naplatiti za pokriće gubitaka nastalih otkazom rezervacije, prema sljedećoj ljestvici:

  • do 45 dana prije polaska - 40% cijene aranžmana
  • 45 do 30 dana prije polaska - 50% cijene aranžmana
  • 29 do 22 dana prije polaska - 60% cijene aranžmana
  • 21 do 15 dana prije polaska - 80% cijene aranžmana
  • 14 do 0 dana prije polaska - 100% cijene aranžmana
  • nakon polaska i "no show", odnosno nedolazak na polazak - 100% cijene aranžmana.

Ukoliko Putnik nema ugovoreno osiguranje od otkaza putovanja i iz bilo kojeg razloga mora otkazati putovanje, Agencija zadržava uplaćenu akontaciju, a ovisno o broju preostalih dana do polaska, Putnik je dužan platiti gore definirani postotak od preostali iznos aranžmana kao kaznu. Navedeni troškovi otkazivanja odnose se i na promjene datuma polaska ili smještajnog objekta, kao i na sve druge bitne promjene.

Ako Putnik na vlastiti zahtjev prekine putovanje u tijeku, nema pravo na naknadu troškova nastalih zbog prijevremenog povratka u mjesto polaska. U slučaju otkazivanja putovanja koje uključuje prijevoz avionom i/ili brodom, uvjeti povrata novca definirani su uvjetima i pravilima zračne ili brodske kompanije.

Usmeni otkaz Ugovaratelj/Putnik mora potvrditi pismenim putem, pismom ili e-poštom. Ukoliko Ugovaratelj/Putnik pismeno ne potvrdi usmeno priopćeni otkaz, smatrat će se da nije otkazao putovanje. Ukoliko Ugovaratelj/Putnik najkasnije 14 dana prije polaska na putovanje nije uplatio ostatak iznosa ili osigurao nespornu uplatu cjelokupnog iznosa aranžmana, Agencija će smatrati da je Ugovaratelj/Putnik odustao od putovanja, te zadržava pravo otkazati rezervaciju bez mogućnosti povrata akontacije za putovanje. Putnik ima pravo bez naknade prenijeti Ugovor o putovanju na drugu osobu bez promjene elemenata sklopljenog ugovora (odnosno priopćiti agenciji imena zamjenskih putnika). Putno osiguranje nije prenosivo na drugu osobu.

TRAVEL CANCELLATION BY THE CONTRACTOR / PASSENGER Cancellation of the reservation/trip must be sent or delivered to the Agency in writing.
The date of written cancellation is the basis for the calculation of fees, i.e. cancellation costs (cancellation penalty), which the Agency will charge to cover the losses incurred due to the cancellation of the reservation, according to the following scale:

  • up to 45 days before departure - 40% of the price of the arrangement
  • 45 to 30 days before departure - 50% of the package price
  • 29 to 22 days before departure - 60% of the package price
  • 21 to 15 days before departure - 80% of the package price
  • 14 to 0 days before departure - 100% of the price of the arrangement
  • after departure and "no show", i.e. failure to appear at departure - 100% of the price of the arrangement.

If the Traveler does not have travel cancellation insurance and has to cancel the trip for any reason, the Agency retains the advance payment, and depending on the number of days remaining until departure, the traveler is obliged to pay the above-defined percentage of the remaining amount of the arrangement as a penalty. The mentioned cancellation costs also apply to changes in the date of departure or the accommodation facility, as well as to all other important changes.

If the Traveler interrupts the trip in progress at his own request, he is not entitled to compensation for the costs incurred due to an early return to the place of departure. In case of cancellation of a trip that includes transportation by plane and/or ship, the conditions for refunding money are defined by the conditions and rules of the airline or shipping company.

Verbal cancellation must be confirmed by the Contractor/Traveler in writing either by letter or email. If the Contractor/Traveler does not confirm the verbally communicated cancellation in writing, it will be considered that he has not canceled the trip. If the Contractor/Traveler has not paid the rest of the amount or ensured undisputed payment of the entire amount of the arrangement no later than 14 days before departure, the Agency will consider that the Contractor/Traveler has abandoned the trip, and reserves the right to cancel the reservation without the possibility of returning the advance payment for the trip. The passenger has the right to transfer the Travel Contract to another person without compensation without changing the elements of the concluded contract (that is, to inform the agency of the names of substitute passengers). Travel insurance is not transferable to another person.


PUTNA DOKUMENTACIJA Putnom dokumentacijom smatraju se dokumenti koje je Agencija dužna predati Ugovaratelju/Putniku, a koji su nužni za realizaciju ugovorenog putovanja (primjerice originalni voucher, program putovanja, zrakoplovne karte, eventualne pismene obavijesti i sl.). ).

Svi putni dokumenti bit će dostavljeni e-poštom Ugovaratelju/Putniku najkasnije 2 dana prije polaska, osim ako nije drugačije navedeno u programu putovanja. Kako bi se izbjegle nedoumice, putne isprave u smislu Općih uvjeta ne smatraju se putnim ispravama koje su Putniku potrebne za putovanje. Na većini autobusnih putovanja putnici pri polasku trebaju samo putnu ispravu (putovnicu ili osobnu iskaznicu), a pratitelj ima sve potrebne vouchere za cijelu grupu. U rijetkim slučajevima da je potrebno nešto dodatno, to će biti navedeno u Završnoj obavijesti koja se šalje na e-mail dva kalendarska dana prije polaska.

TRAVEL DOCUMENTATION Travel documentation is considered to be the documents that the Agency is obliged to hand over to the Contractor/Traveller, and which are necessary to realize the contracted trip (for example, original voucher, travel program, airline tickets, possible written notices, etc.).

All travel documents will be delivered by email to the Contractor/Traveller no later than 2 days before departure, unless otherwise stated in the travel program. In order to avoid any doubts, travel documents in the sense of the General Conditions are not considered travel documents that are necessary for the Traveler to travel. On most bus trips, passengers only need a travel document (passport or identity card) upon departure, and the travel companion has all the necessary vouchers for the entire group. In the rare cases that something additional is needed, it will be stated in the Final Notification, which is sent to the email two calendar days before departure.


PUTNE ISPRAVE I POŠTOVANJE PROPISA Putnik koji se prijavljuje na putovanje dužan je o vlastitom trošku pribaviti valjane putne isprave koje će vrijediti za cijelo vrijeme trajanja putovanja te se prije polaska pobrinuti da posjeduje sve potrebne putne isprave. Agencija nije nadležna niti odgovorna za ishođenje viza niti informiranje putnika o tome, već je to odgovornost samog Putnika.

Ugovaratelj/Putnik snosi isključivu odgovornost za slučaj da ne može završiti putovanje zbog nedostatka važećih putnih isprava ili ako mu zahtjev za vizu bude odbijen. U tom slučaju smatra se da je Ugovaratelj/Putnik otkazao putovanje, te se primjenjuju uvjeti otkaza od strane Ugovaratelja/Putnika.

Putnik je dužan pridržavati se carinskih, deviznih i drugih propisa. Ukoliko Putnik zbog nepoštivanja propisa ne može nastaviti putovanje, agencija zadržava pravo nastaviti putovanje bez Putnika koji snosi sve troškove i posljedice koje iz toga proizlaze.

U slučaju krađe ili gubitka putnih isprava tijekom putovanja, Putnik snosi troškove pribavljanja novih isprava, kao i troškove koji iz toga proizlaze. Putnik je dužan osigurati da on osobno, njegovi dokumenti i prtljaga ispunjavaju uvjete propisane viznim, graničnim, carinskim, zdravstvenim i drugim propisima, kako Republike Hrvatske tako i države u koju putuje. Agencija neće snositi odgovornost za odluke carinskih, policijskih i drugih službenih tijela kojima se Putniku ne dopušta ulazak ili izlazak iz pojedine zemlje, te se u tom slučaju primjenjuju odredbe ovih Općih uvjeta koje se odnose na otkazivanje putovanja. od strane Ugovaratelja/Putnika.

Također, Putnik je dužan pridržavati se kućnog reda u ugostiteljskim i hotelskim objektima te dobronamjerno surađivati s predstavnikom Agencije i davateljima usluga. U slučaju nepoštivanja gore navedenih obveza, Putnik odgovara za nastalu štetu, a Agencija otklanja svaku odgovornost za nastalu štetu. U tom slučaju iznos štete Putnik namiruje s vlasnikom objekta (hotela, apartmana i sl.).

Svi putnici koji nisu državljani Hrvatske i nemaju hrvatske putne isprave trebaju se osobno informirati o zemlji u koju putuju i uvjetima koje je potrebno ispuniti za putovanje u tu zemlju, s obzirom na različite propise koji vrijede za državljane pojedinih država. , prije uplate aranžmana. Preporučamo da se svaki putnik osobno informira na web stranici www.mvep.hr  te pogleda preporuke Ministarstva vanjskih poslova za putovanje u pojedinu zemlju. Nevaljane putne isprave, odnosno neodobravanje vize, koje ima za posljedicu otkazivanje putovanja, ni u čemu ne obvezuje Agenciju, te se primjenjuju uvjeti otkaza putovanja od strane Ugovaratelja/Putnika. Agencija otklanja svaku odgovornost za štetu koja bi proizašla iz nepridržavanja propisa pojedine zemlje ili koja bi nastala nevažećim putnim ispravama.

TRAVEL DOCUMENTS AND COMPLIANCE WITH REGULATIONS The passenger applying for the trip is obliged to obtain valid travel documents at his own expense, which will be valid for the entire duration of the trip, and to ensure that he has all the necessary travel documents before departure. The Agency is not in charge or responsible for obtaining visas or informing travelers about it, but it is the responsibility of the Traveler himself. 

The Contractor/Traveler is solely responsible for the event that he is unable to complete the trip due to lack of valid travel documents or if his request for a visa is rejected. In this case, it is considered that the Contractor/Traveler has canceled the trip, and the terms of cancellation by the Contractor/Traveler will be applied. 

The passenger is obliged to comply with customs, foreign exchange and other regulations. If the Traveler cannot continue the trip due to non-compliance with the regulations, the agency reserves the right to continue the trip without the Traveler, who bears all costs and consequences that arise as a result. 

In case of theft or loss of travel documents during the trip, the Passenger will bear the costs of obtaining new documents, as well as the costs that may arise from this. The traveler is obliged to ensure that he personally, his documents and luggage meet the conditions stipulated by visa, border, customs, health and other regulations, both of the Republic of Croatia and of the country to which he is traveling. The Agency will not be responsible for the decisions of customs, police and other official bodies that do not allow the Traveler to enter or leave a particular country, and in that case the provisions of these General Terms and Conditions relating to the cancellation of the trip by the Contractor/Traveler shall apply. 

Also, the Traveler is obliged to comply with the house rules in catering and hotel facilities and to cooperate with the representative of the Agency and service providers in good faith. In case of failure to comply with the above obligations, the Traveler is responsible for the damage caused, and the Agency removes any responsibility for such damage. In this case, the amount of damage is settled by the Traveler with the owner of the facility (hotel, apartment, etc.). 

All travelers who are not citizens of Croatia and do not have Croatian travel documents should personally inform themselves about the country they are traveling to and the conditions that must be met for traveling to that country, given the different regulations that apply to citizens of individual countries, before paying for the arrangement. We recommend that every traveler get information personally on the website www.mvep.hr and look at the recommendations of the Ministry of Foreign Affairs for traveling to a certain country. Invalid travel documents, i.e. disapproval of a visa, which results in cancellation of the trip, does not obligate the Agency in any respect, and the terms of cancellation of the trip by the Contractor/Traveler apply. The agency removes any responsibility for damage that would result from non-compliance with the regulations of individual countries or that would be caused by invalid travel documents.


PUTNO OSIGURANJE U cijenu putovanja nije uključeno osiguranje od rizika nesretnog slučaja i putne bolesti, osiguranje od štete i gubitka prtljage, kao ni dobrovoljno zdravstveno osiguranje.

Agencija nudi Ugovaratelju/Putniku mogućnost doplate paketa putnog osiguranja (zdravstveno osiguranje i osiguranje od otkaza putovanja iz opravdanih razloga), a putniku nudi mogućnost i drugih oblika osiguranja uz nadoplatu, a ugovaranjem Putovanja Ugovorom, čiji su sastavni dio ovi uvjeti, Ugovaratelj/Putnik potvrđuje da mu je ponuđeno osiguranje.

Ponuđene cijene osiguranja odnose se na grupnu policu koja će biti uz pratitelja.

Moguće je da putnik napravi individualnu policu osiguranja koja će mu biti uručena odmah nakon uplate, međutim navedeno treba imati na umu prije uplate aranžmana (cijene individualnih polica su cca. 40% veće od grupnih za iste). osiguranje i rizici).

  U slučaju zamjene putnika, polica osiguranja nije prenosiva na nove putnike.

TRAVEL INSURANCE Travel prices do not include insurance against the risk of an accident and travel illness, insurance against damage and loss of luggage, as well as voluntary health insurance. 

The Agency offers the Contractor/Traveler the option of paying extra for a travel insurance package (health insurance and travel cancellation insurance due to justified reasons), and offers travelers the option of other forms of insurance with an additional supplement, and by concluding the Travel Contract, of which these terms and conditions are an integral part, The Contractor/Traveler confirms that he has been offered insurance. 

The offered insurance prices refer to the group policy that will be with the travel companion. 

It is possible for travelers to make an individual insurance policy that will be handed to them immediately after payment, however, the above should be noted before paying for the arrangement (prices of individual policies are approx. 40% higher than group policies for the same insurance coverage and risks).

 In case of replacement of passengers, the insurance policy is not transferable to new passengers.


OSIGURANJE OD RIZIKA OTKAZA PUTOVANJA Preporučamo uplatu police osiguranja od otkaza putovanja, pri čemu se putniku vraća 90% iznosa aranžmana. U slučaju otkazivanja aranžmana i aktivacije police osiguranja putniku se ne vraća uplaćeni iznos premije police osiguranja. Svi uvjeti otkazivanja navedeni su u uvjetima rezervacije te svakako preporučamo da ih svaki putnik osobno detaljno prouči.

TRAVEL INSURANCE We recommend paying for a travel cancellation insurance policy, during which the traveler will be reimbursed 90% of the amount of the arrangement. A cancellation insurance policy must be agreed upon when booking and concluding the Travel Agreement, and it is not possible to conclude this insurance policy subsequently. 

In order to be able to activate the cancellation insurance policy, it is necessary to make the rest of the payment in percentage as defined in the segment "CANCELATION OF TRAVEL BY THE CONTRACTOR / PASSENGER" depending on the date of the written cancellation, which is the basis for the calculation of fees, i.e. cancellation costs (cancellation penalty). , which the Agency will charge to cover the losses incurred due to the cancellation of the reservation. 

All cancellation conditions are listed in the booking conditions, and we definitely recommend that every passenger study them personally in detail.


PROMJENA PROGRAMA ILI OTKAZ OD PUTOVANJA OD STRANE AGENCIJE Agencija ima puno pravo promjene redoslijeda izleta bez promjene sadržaja programa.

Ukoliko nastupe izvanredne okolnosti koje se ne mogu predvidjeti, izbjeći ili otkloniti, Agencija također može promijeniti sadržaj programa putovanja. Ugovoreni smještaj može se zamijeniti samo smještajem u objektu iste ili više kategorije.

Agencija zadržava pravo promjene vremena putovanja, bez obzira na razlog, do 3 sata od planiranog vremena polaska. Agencija zadržava pravo promjene dana putovanja zbog promjene reda letenja ili zbog nastupa nepredviđenih okolnosti, pravo promjene smjera putovanja ukoliko se promijene uvjeti putovanja (promijenjen red letenja, sigurnosna situacija u određena država, loše vrijeme ili drugi razlozi koji će omogućiti učinkovitiju provedbu programa bez promjene sadržaja putovanja) i bez naknade, prema važećim propisima u domaćem i međunarodnom prometu.

Agencija ne preuzima odgovornost za promjene nastale uslijed nepredviđenih okolnosti i više sile tijekom putovanja. Ukoliko Agencija bitno promijeni program putovanja prije početka putovanja, dužna je o tome pisanim putem obavijestiti Ugovaratelja/Putnika.

Agencija ne snosi odgovornost za eventualne pogreške u objavi programa, kao ni za netočne unose podataka od strane operatera na web stranicama. Bez obveze obeštećenja Ugovaratelja/Putnika, Agencija može otkazati putovanje zbog više sile koja može nastupiti prije ili tijekom putovanja, u slučaju da se za putovanje ne prijavi dovoljan broj putnika navedenih u programu putovanja, U tom slučaju Agencija će / Obavijestiti putnika o otkazu putovanja 7 dana prije početka aranžmana, te će u tom slučaju izvršiti povrat cjelokupnog uplaćenog iznosa aranžmana.

Uplatom dijela ili cijelog iznosa aranžmana Ugovaratelj/Putnik izjavljuje da je upoznat s činjenicom da niti jedan paket-aranžman nema zajamčen polazak dok se u određenoj grupi/autobusu ne skupi najmanje 40 prijavljenih putnika, da je će o ovoj činjenici obavijestiti ostale putnike na istoj rezervaciji, te da neće ugovarati nikakve dodatne usluge vezane uz polazak na putovanje (transfer od/do mjesta polaska na putovanje, smještaj u mjestu polaska i sl.). .) dok mu Agencija izričito ne potvrdi pisanim putem da je polazak zajamčen, u kojem slučaju će se koristiti izraz „zajamčeni polazak“, te da to ne može biti temelj za prigovor ili javno izražavanje nezadovoljstva, s obzirom da navedeno ne ovisi o Agenciji, te da je putnik o navedenom unaprijed obaviješten. Agencija, kao privatna tvrtka koja pruža usluge organizacije putovanja, nije dužna pružati ovu uslugu te zadržava pravo otkaza putovanja svakom klijentu, odnosno ugovaratelju putovanja i drugim osobama na istoj rezervaciji, u slučaju da ocijeni da da jedan od putnika ne postupa u dobroj vjeri prije polaska i/ili da bi moglo utjecati na udobnost ostalih putnika u grupi tijekom putovanja njihovim nezadovoljstvom iskazanim prije polaska, u kojem slučaju će agencija obavijestiti gosta o otkazu. putovanja 7 dana prije početka aranžmana i vratiti cjelokupan uplaćeni iznos aranžmana, a putnik ugovaranjem putovanja izjavljuje da je s tim stvarno upoznat.

CHANGE OF THE PROGRAM OR CANCELLATION OF THE TRIP BY THE AGENCY The agency has full right to change the order of the tours without changing the content of the program. 

If extraordinary circumstances occur that cannot be predicted, avoided or removed, the Agency can also change the content of the travel program. The contracted accommodation can only be replaced with accommodation in a facility of the same or higher categorization. 

The agency reserves the right to change the travel time, regardless of the reason, up to 3 hours from the scheduled departure time. The agency reserves the right to change the day of travel due to a change in the flight schedule or due to the occurrence of unforeseen circumstances, the right to change the direction of travel if the conditions for travel change (changed flight schedule, security situation in a certain country, bad weather or other reasons that will enable a more efficient implementation of the program without changing contents of the trip) and without compensation, according to the applicable regulations in domestic and international traffic. 

The agency does not assume responsibility for changes due to unforeseen circumstances and force majeure during the trip. If the Agency significantly changes the travel program before the start of the trip, it is obliged to notify the Contractor/Traveler in writing. 

The Agency is not responsible for any errors in the publication of the program, as well as for incorrect data entries by the operator on the web pages. Without the obligation to compensate the Contractor/Traveler, the Agency may cancel the trip due to force majeure that may occur before or during the trip, in the event that a sufficient number of Passengers indicated in the travel program do not register for the trip, in which case the Agency will / Inform the traveler about the cancellation of the trip 7 days before the start of the arrangement, and in that case will refund the entire paid amount of the arrangement. 

By paying part or all of the amount of the arrangement, the Contractor/Traveler declares that he is aware of the fact that no package-arrangement has a guaranteed departure until at least 40 registered passengers are gathered on a particular group/bus, that he will inform the other passengers on the same reservation about this fact, and that he will not contract any additional services related to the departure of the trip (transfer from/to the point of departure for the trip, accommodation in the city of departure, etc.) until the Agency specifically confirms to him in writing that the departure is guaranteed, in which case the term will be used "guaranteed departure", and that this cannot be a basis for a complaint or a public expression of dissatisfaction, given that the aforementioned does not depend on the Agency, and that the passenger is informed about the aforementioned in advance. The agency, as a private company that provides travel organization services, is not obliged to provide this service and reserves the right to cancel the trip of each client, i.e. the travel contractor and other persons on the same reservation, in the event that it assesses that one of the passengers does not act in good faith before departure and/or that could affect the comfort of the other passengers in the group during the trip by their dissatisfaction expressed before departure, in which case the agency will inform the client about the cancellation of the trip 7 days before the start of the arrangement and return the entire amount paid for the arrangement, and the traveler, by contracting the trip, declares that he is aware of this by fact.


PRTLJAGA Agencija ne odgovara za uništenu, ukradenu ili izgubljenu prtljagu, kao ni za krađu prtljage ili dragocjenosti u hotelu, odnosno prijevoznom sredstvu (preporuča se ugovoriti osiguranje prtljage prije polaska, u kojem slučaju agencija može pomoć na zahtjev putnika, kao i najam i korištenje sefa po potrebi u odredištu). Eventualnu štetu/otuđenje Putnik je dužan prijaviti prijevozniku ili recepciji smještajnog objekta.

Ukoliko postoje ograničenja u pogledu težine dopuštene prtljage, koja je uključena u cijenu aranžmana, to ovisi o zračnom prijevozniku koji putuje i bit će posebno naznačeno u završnom pismu. Višak prtljage plaća putnik prema važećim cijenama prijevoznika.

Djeca, bez obzira na dob, nemaju pravo na besplatan prijevoz prtljage u zračnom prijevozu. Prilikom putovanja autobusom putnik može ponijeti najviše 2 komada osobne prtljage. Putnici su dužni voditi računa o svojim stvarima i ponijeti ih sa sobom svaki put kada napuštaju autobus. Putnik je odgovoran za krađu, gubitak ili oštećenje stvari ostavljenih bez nadzora.

LUGGAGE The agency is not responsible for destroyed, stolen or lost luggage, as well as for the theft of luggage or valuables in the hotel, i.e. in the means of transport (it is recommended to arrange luggage insurance before departure, in which case the agency can assist at the request of the passenger, as well as the rental and use of a safe if necessary in the destination). The Passenger must report any damage/alienation to the carrier or the reception of the accommodation facility.

If there are restrictions regarding the weight of the allowed luggage, which is included in the price of the arrangement, it depends on the airline on air travel and will be specifically indicated in the final letter. Excess luggage is paid by the passenger according to the applicable prices of the carrier.

Children, regardless of age, are not entitled to free baggage transportation in air transport. When traveling by bus, a passenger can take a maximum of 2 pieces of personal luggage. Passengers are obliged to take care of their belongings and take them with them every time they leave the bus. The passenger is responsible for the theft, loss or damage of belongings left unattended.


DRUGI Sukladno Zakonu o pružanju usluga u turizmu, Gavan turizam d.o.o. ima s osiguravajućim društvom Wiener osiguranje - Vienna Insurance Group d.d., Slovenska ulica 24, 10000 Zagreb, ugovorenu policu broj 1322-00041078 o osiguranju profesionalne odgovornosti za štetu prouzročenu putniku neispunjenjem, djelomičnim ispunjenjem ili neurednim ispunjenjem obveza vezanih uz paket aranžman. Standardni podaci za ugovore o paket aranžmanima: Ponuđena kombinacija usluga putovanja je paket aranžman u smislu Zakona o pružanju usluga u turizmu. Putnik stoga ima sva prava koja proizlaze iz odredaba Zakona o pružanju usluga u turizmu koje se odnose na paket aranžmane. Turistička agencija Gavan turizam d.o.o. je u potpunosti odgovoran za kvalitetnu realizaciju paket aranžmana u cjelini. Turistička agencija Gavan turizam d.o.o. ima zakonom propisano osigurano jamstvo za naknadu putnikovih uplata i osiguranje povratka putnika u domovinu u slučaju nelikvidnosti. Najvažnija prava sukladno Zakonu o pružanju usluga u turizmu: Sve bitne informacije o paket aranžmanu putnik će dobiti prije sklapanja ugovora o putovanju u paket aranžmanu. Uvijek postoji najmanje jedan trgovac koji je odgovoran za pravilno izvršenje svih usluga putovanja obuhvaćenih ugovorom. Putnici dobivaju broj mobitela za hitne slučajeve ili informacije o kontakt točki putem koje mogu stupiti u kontakt s organizatorom ili turističkom agencijom (broj mobitela pratitelja za sve hitne slučajeve dobit će dva dana prije početka putovanja u konačna obavijest). Putnici mogu prenijeti paket aranžman na drugu osobu uz razumnu najavu i eventualno plaćanje dodatnih troškova. Cijena paket aranžmana može se povećati samo u slučaju povećanja određenih troškova (primjerice cijena goriva) i ako je to izričito ugovoreno ugovorom, a u svakom slučaju najkasnije 20 dana prije početka paket aranžmana. Ukoliko povećanje cijene prelazi 8% cijene paket aranžmana, putnik može raskinuti ugovor. Ako organizator zadržava pravo povećanja cijene, putnik ima pravo na sniženje cijene ako se smanje pripadajući troškovi. Putnik može raskinuti ugovor bez plaćanja naknade za raskid i dobiti povrat svih uplaćenih sredstava ako se bitno promijeni bilo koji od bitnih elemenata paket aranžmana osim cijene. Ukoliko prije početka paket-aranžmana trgovac odgovoran za paket-aranžman otkaže paket-aranžman, putnik ima pravo na povrat novca, a po potrebi i na naknadu štete (naknada je moguća samo u slučaju da je polazak zajamčen do Putnik pisanim putem od strane Agencije, uz naznaku "garantirani polazak", te da su putnici slijedom toga ugovorili dodatne usluge kao što su transferi od/do mjesta polaska. Putnici mogu raskinuti ugovor bez plaćanja naknade za raskid prije početka putovanja. paket aranžman u slučaju izvanrednih okolnosti, primjerice ako na odredištu postoje ozbiljni sigurnosni problemi koji bi mogli utjecati na paket aranžman. Osim toga, putnici mogu raskinuti ugovor bilo kada prije početka paket aranžmana uz uplatu odgovarajuće naknada za raskid koja bi mogla biti opravdana Ako se nakon početka paket aranžmana značajni elementi paket aranžmana ne mogu osigurati prema dogovoru, morat će se ponuditi alternativni aranžmani bez dodatnih troškova. Ako usluge nisu pružene u skladu s ugovorom i to bitno utječe na izvršenje paket aranžmana, a organizator ne otkloni nesukladnosti, putnici mogu raskinuti ugovor o paket aranžmanu bez plaćanja naknade za raskid. Putnici imaju pravo na sniženje cijene i/ili naknadu ako putne usluge nisu izvršene ili su nepropisno izvršene. Ako se putnik nađe u poteškoćama, organizator mu je dužan pružiti pomoć. Ako organizator, ili u nekim državama članicama prodavač, postane nesolventan, osiguran je povrat novca. Ukoliko organizator ili po potrebi prodavatelj nakon početka paket-aranžmana postane insolventan i ako je prijevoz uključen u paket-aranžman, putnicima je osigurana repatrijacija. U skladu s uredbom Europske unije br. 524/2013. (platforma za online rješavanje sporova) o online rješavanju potrošačkih sporova, članak 14. stavak 1. omogućuje online rješavanje potrošačkih sporova putem: elektroničke poveznice. Nadležno tijelo za poslovanje Turističke agencije Gavan turizam d.o.o. je Ministarstvo turizma Republike Hrvatske, Prisavlje 14, 10 000 Zagreb. Nakon izvršene uplate aranžmana, putnici navedeni u ugovoru o putovanju mogu ostvariti svoja prava izravno putem ovog dokumenta i podataka iz osiguranja jamčevine (Ugovor o osiguranju jamčevine za turističke paket aranžmane broj 1501-00000719) kod Wiener osiguranja - Vienna Insurance Group d.d. , OIB: 52848403362, Slovenska ulica 24, 10000 Zagreb, kontakt@wiener   +385 (0)1 371 86 00 ili 0800 25 80.

THE OTHER In accordance with the Act on providing services in tourism, Gavan turizam d.o.o. has with the insurance company Wiener osiguranje - Vienna Insurance Group d.d., Slovenska ulica 24, 10000 Zagreb, contracted policy number 1322-00041078 on professional liability insurance for damage caused to the passenger by non-fulfilment, partial fulfillment or improper fulfillment of obligations related to the package arrangement . Standard information for package travel contracts: The offered combination of travel services is a package arrangement within the meaning of the Act on the provision of services in tourism. The traveler therefore has all the rights arising from the provisions of the Act on the provision of services in tourism that refer to package arrangements. Tourist agency Gavan turizam d.o.o. is fully responsible for the proper execution of the package arrangement as a whole. The tourist agency Gavan turizam d.o.o. has a legally prescribed insured guarantee for compensation of the passenger's payments and ensuring the repatriation of the passenger in case it becomes insolvent. The most important rights in accordance with the Law on the provision of services in tourism: Travelers will receive all essential information about the package arrangement before concluding a contract on travel in a package arrangement. There is always at least one merchant who is responsible for the proper execution of all travel services covered by the contract. Travelers receive an emergency mobile phone number or information about a contact point through which they can get in touch with the organizer or travel agency (the mobile phone number of the travel companion for all emergencies will be provided two days before the start of the trip in the final notification). Passengers can transfer the package arrangement to another person with reasonable notice and possible payment of additional costs. The price of the package arrangement can be increased only if specific costs (for example, the price of fuel) increase and if this is expressly stipulated in the contract, and in any case no later than 20 days before the start of the package arrangement. If the price increase exceeds 8% of the price of the package arrangement, the passenger can terminate the contract. If the organizer reserves the right to increase the price, the passenger has the right to a price reduction if the relevant costs are reduced. Travelers can terminate the contract without paying any termination fee and receive a full refund of all payments if any of the essential elements of the package arrangement other than the price are significantly changed. If, before the start of the package arrangement, the merchant responsible for the package arrangement cancels the package arrangement, passengers have the right to a refund and, if necessary, compensation (compensation is possible only in the event that the departure was guaranteed to the Passenger in writing by the Agency, with the words "guaranteed departure", and that passengers have consequently agreed on additional services such as transfers from/to the place of departure. Passengers can terminate the contract without paying any termination fee before the start of the package arrangement in case of extraordinary circumstances, for example if there are serious security problems at the destination which could affect the package arrangement. In addition, passengers may terminate the contract at any time prior to the commencement of the package arrangement upon payment of an appropriate termination fee that may be justified. If after the commencement of the package arrangement significant elements of the package arrangement cannot be provided as agreed, alternative arrangements will have to be offered without additional costs. If the services are not provided in accordance with the contract and this significantly affects the execution of the package arrangement, and the organizer does not correct the non-conformity, the travelers may terminate the package travel contract without payment termination fees. Passengers have the right to a price reduction and/or compensation if the travel services are not performed or if they are performed improperly. If the traveler finds himself in difficulties, the organizer must provide him with help. If the organizer, or in some member states the seller, becomes insolvent, a refund is provided. If the organizer or, if necessary, the seller becomes insolvent after the start of the package arrangement and if the transportation is included in the package arrangement, the repatriation of the passengers is ensured. In accordance with the regulation of the European Union no. 524/2013. (Online Dispute Resolution platform) on online resolution of consumer disputes, Article 14 paragraph 1 enables online resolution of consumer disputes via: electronic link. The competent authority for the business of the Travel Agency Gavan turizam d.o.o. is the Ministry of Tourism of the Republic of Croatia, Prisavlje 14, 10 000 Zagreb. After paying for the package, the passengers named in the travel contract can exercise their rights directly through this document and the information provided under the guarantee insurance (Guarantee insurance contract for tourist package arrangements number 1501-00000719) with Wiener osiguranje - Vienna Insurance Group d.d., OIB: 52848403362, Slovenska ulica 24, 10000 Zagreb, kontakt@wiener  +385 (0)1 371 86 00 or 0800 25 80.


PUTOVANJA U ORGANIZACIJI DRUGIH ORGANIZATORA Ovi Opći uvjeti vrijede za sve aranžmane u kojima je Agencija glavni organizator, osim u slučaju kada Agencija djeluje kao posrednik, odnosno nije glavni organizator putovanja. Za takve aranžmane u ugovoru će biti naznačen odgovorni organizator, a za to putovanje vrijede opći uvjeti odgovornog organizatora, a Agencija ne odgovara za realizaciju turističkih aranžmana od strane drugih organizatora. Potpisom ugovora Ugovaratelj/Putnik u cijelosti prihvaća program i uvjete putovanja.

TRAVEL IN THE ORGANIZATION OF OTHER ORGANIZERS These General Conditions apply to all arrangements where the Agency is the main organizer, except in the case where the Agency acts as an intermediary, i.e. it is not the main travel organizer. For such arrangements, the responsible organizer will be indicated in the contract, and the general terms and conditions of the responsible organizer will apply to that trip, and the Agency is not responsible for the implementation of tourist arrangements by other organizers. By signing the contract, the Contractor/Traveler fully accepts the program and conditions of the trip.


ZAVRŠNE ODREDBE Ovi Opći uvjeti i upute za turističke aranžmane sastavni su dio Ugovora koji Ugovaratelj/Putnik sklapa s Agencijom. Uplatom akontacije ili cjelokupnog iznosa aranžmana Ugovaratelj/Putnik u cijelosti prihvaća program i uvjete putovanja, te je Ugovor važeći i bez potpisa Ugovaratelja/Putnika.

Ovi Opći uvjeti stupaju na snagu 26. lipnja 2018. godine

FINAL PROVISIONS These general conditions and instructions for tourist arrangements are an integral part of the Agreement that the Contractor/Traveler enters into with the Agency. By paying the advance payment or the entire amount of the arrangement, the Contractor/Traveler fully accepts the program and conditions of the trip, and the Agreement is valid even without the signature of the Contractor/Traveler.
